1. Agreement to Terms

By accessing or using GunStoreData's services, including our OnTarget AI Search and Product Data Feed products ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

These Terms constitute a legally binding agreement between you (whether personally or on behalf of an entity, "you") and GunStoreData ("we," "us," or "our").

2. Description of Services

GunStoreData provides:

  • OnTarget AI Search: An AI-powered search solution for firearms retail websites, providing typo tolerance, autocomplete, faceted filtering, and search analytics.
  • Product Data Feed: Aggregated product data from firearms distributors, delivered via API or through platform integrations.
  • Platform Integrations: Odoo modules and WooCommerce plugins for seamless integration with your existing systems.

3. Account Registration

3.1 Eligibility

To use our Services, you must:

  • Be at least 18 years of age
  • Be a licensed firearms retailer (Federal Firearms License holder) or authorized representative
  • Provide accurate, complete, and current registration information
  • Maintain the security of your account credentials

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials and API keys
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach

4. Subscription and Payment

4.1 Subscription Plans

Our Services are offered on a subscription basis. Current pricing is available at gunstoredata.com/pricing. We reserve the right to modify pricing with 30 days' notice.

4.2 Billing

  • Subscriptions are billed monthly in advance
  • Payment is due upon subscription activation and on each monthly anniversary
  • All fees are non-refundable except as expressly stated in these Terms
  • You authorize us to charge your designated payment method for all applicable fees

4.3 Cancellation

You may cancel your subscription at any time through your account dashboard or by contacting support. Cancellation will take effect at the end of the current billing period. No refunds will be provided for partial months.

5. Acceptable Use

5.1 Permitted Use

You may use our Services only for lawful purposes and in accordance with these Terms. Our Services are intended for use by licensed firearms retailers for:

  • Enhancing product search functionality on your website
  • Importing and managing product data from distributors
  • Analyzing search behavior and improving customer experience

5.2 Prohibited Use

You agree not to:

  • Use the Services for any illegal or unauthorized purpose
  • Violate any applicable federal, state, or local laws or regulations
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Transmit viruses, malware, or other malicious code
  • Interfere with or disrupt the integrity or performance of the Services
  • Resell, sublicense, or redistribute our Services without authorization
  • Use the Services to collect or harvest personal information
  • Reverse engineer, decompile, or disassemble any aspect of the Services
  • Exceed API rate limits or engage in activities that place excessive load on our infrastructure

6. Intellectual Property

6.1 Our Intellectual Property

The Services, including all software, algorithms, documentation, and related materials, are owned by GunStoreData and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services during your subscription term.

6.2 Your Content

You retain ownership of your product data and content. By using our Services, you grant us a license to use, process, and display your content solely for the purpose of providing the Services.

6.3 Feedback

Any feedback, suggestions, or ideas you provide regarding the Services may be used by us without obligation or compensation to you.

7. Data and Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Services, you consent to the data practices described in the Privacy Policy.

8. Third-Party Services

Our Services integrate with third-party platforms and distributor APIs. We are not responsible for:

  • The availability, accuracy, or completeness of third-party data
  • Changes to third-party APIs or services
  • The privacy practices or security measures of third parties

Your use of third-party services is subject to their respective terms and conditions.

9. Disclaimers

9.1 Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. We may suspend or discontinue the Services temporarily for maintenance, updates, or circumstances beyond our control.

9.2 No Warranty

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.3 Data Accuracy

While we strive to provide accurate product data, we do not guarantee the accuracy, completeness, or timeliness of information obtained from third-party distributors. You are responsible for verifying product information before use.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GUNSTOREDATA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless GunStoreData and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your content or data

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting us or through your account settings.

12.2 Termination by Us

We may suspend or terminate your access to the Services immediately if:

  • You breach these Terms
  • You fail to pay fees when due
  • We are required to do so by law
  • We discontinue the Services

12.3 Effect of Termination

Upon termination, your right to use the Services will cease immediately. We will delete your data within 30 days of termination, unless retention is required by law.

13. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Services. Your continued use after changes become effective constitutes acceptance of the modified Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court.

15. General Provisions

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and GunStoreData.
  • Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.
  • Waiver: Our failure to enforce any right does not constitute a waiver of that right.
  • Assignment: You may not assign these Terms without our consent. We may assign these Terms freely.
